Military Air Crashes

Representing Service Members and Their Families After Military Aircraft Accidents

Many military personnel take on the risks of air flight on a regular basis, trusting in their superiors to properly maintain and staff their aircraft and monitor weather conditions. When a military airplane or helicopter is involved in an aircraft crash or another accident, the military may be legally responsible for compensating military crash victims and their families.

I'm Jim Pokorny, an experienced San Diego attorney and a licensed pilot representing military personnel and their loved ones in aircraft accident cases. Contact me to discuss your potential negligence or wrongful death claim arising out of a military helicopter crash.

Understanding Legal Claims Against the Military

The method for bringing a claim involving a military crash depends on the exact circumstances of the accident and the identities of the injured people seeking compensation. Most military crashes are covered by the Military Claims Act (MCA), a law that creates special military proceedings to hear claims brought against the armed forces.

Civilian lawyers are eligible to represent military or civilian clients in proceedings under the MCA. I would be happy to discuss the circumstances of your case with you.

The MCA covers injuries suffered by military personnel, on military basis and/or involving military aircraft overseas. Civilians injured off base in the United States (such as the residents of homes destroyed in military air crashes) are covered by the Federal Tort Claims Act (FTCA). Proceedings under the FTCA will be brought in federal court.

An Experienced California Aviation Accident Attorney

Despite the complex nature of the laws governing claims against the military, these claims resemble civilian claims in many ways. I bring my extensive experience trying aviation accident cases to bear on every military air crash case I handle.

If you've lost a loved one or been seriously injured in a military crash involving a Navy fighter jet, an Army helicopter, an Air Force plane, or any military aircraft, don't hesitate to contact me to discuss your rights to compensation and accountability. I represent military crash victims and their families in San Diego, California, Camp Pendleton, Irvine, Long Beach and surrounding areas.

From My Clients
  • Dear Jim:
I want to thank you again for the work you did on our airplane crash case. We were very happy with the results but, more importantly, with the attention, care and compassion you and your staff showed us during the difficult and emotional proceedings.

  • My brother was tragically killed as a result of a helicopter accident that stunned our entire family. Mr. Pokorny represented the family in what turned out to be a complicated and lengthy legal battle. His expertise as a pilot and an aviation attorney made all the difference in obtaining a favorable outcome of the case. I would highly recommend his services to others as well.

  • I was a passenger in a small airplane which crashed on takeoff. As a result of the crash, I was seriously injured. I hired Mr. Pokorny and he was able to investigate the situation and ultimately determine the cause of the crash. He was able to get my case resolved and get me compensated for my injuries.

  • I was a passenger in a small helicopter when suddenly it went out of control and literally fell out of the sky. We crashed into a neighborhood near a hospital. The pilot died on impact. I was lucky enough to survive, but with extensive injuries. We hired Mr. Pokorny to figure out what happened, and to get me compensated for my losses. He did both, and very capably.
