The causes of aviation accidents are typically divided into three categories: human errors, equipment and machine errors, and environmental hazards. Human errors can include air traffic control miscommunication, inadequate deicing procedures, and errors in pilot judgment.

All human beings make mistakes, and not every human error is a case of negligence. However, when a person or company fails to follow a clear standard of care, anyone injured by that failure may be entitled to make a legal claim.

Understanding Air Traffic Control Claims

One common human factor in aviation accidents is the failure of air traffic controllers to positively identify aircraft and take account of adverse weather conditions. Claims against air traffic controllers must be brought under the Federal Tort Claims Act (FTCA), as air traffic controllers are employees of the United States government.
